Child seduction sentencing for former Monroeville band teacher

UPDATE (January 14, 2021):

A former band teacher at a Fort Wayne-area school has been sentenced following accusations that he kissed and fondled one of his students.

Prosecutors in Allen County filed charges in December of 2019 against former Monroeville teacher Josiah Pfenning. He was accused of the behavior while working at Heritage High School.

The Allen County Prosecutor’s Office released the following on Wednesday:

“Josiah D. Pfenning was charged in Cause Number 02D04-1912-F6-1562 and subsequently pled guilty to Child Seduction, a Level 5 Felony, on December 21, 2020. Given the law, the victim’s age, and the circumstances of this case, a Level 5 Felony was the highest available charge. A Level 5 Felony carries a sentencing range of 1 year to up to 6 years, with the advisory sentence of 3 years.

The victim’s family spoke on her behalf and talked about the painful 17 month court process and the emotional toll Mr. Pfenning’s actions took on their daughter. It was the family’s wish for the Court to accept this plea agreement so they could have closure for their family and work towards healing.

Today, Mr. Pfenning was sentenced to 5 years, with 5 years on probation. Judge Steven O. Godfrey ordered Mr. Pfenning to abide by the Addendum Order of Probation, which is a collection of specific probation conditions for sexual offenders including intensive sexual perpetrators therapy. Mr. Pfenning will be required to complete the first two years of his sentence on community control, which is akin to house arrest. Mr. Pfenning was ordered to have no contact with his victim for the term of his sentence and was ordered to pay restitution to the victim and her family for expenses they suffered as a result of this crime and the subsequent criminal case. As required by Indiana law for offenses of this kind, Mr. Pfenning will register as a sexual offender as a result of this conviction.

In this case, and sexual offense cases in general, our office respects the wishes of our victims and their families and reflects those wishes in the plea recommendations that are offered to defendants.”
