INDIANAPOLIS, Ind. (ADAMS) – The Indiana Department of Education is being sued by the ACLU of Indiana over a new law concerning how human sexuality is taught.
The lawsuit says neither “human sexuality” nor “instruction” is defined in the bill that Governor Holcomb signed into law last month.
The ACLU filed the lawsuit on behalf of Indianapolis Public Schools teacher Kayla Smiley, who says she does not know if age-appropriate books she has in her classroom that cover some LGBTQ issues would be allowed, and also says she does not know if she is allowed to teach students what the word “gay” means if she hears it used as an insult.
The lawsuit also alleges the new law infringes on the teacher’s First Amendment rights to free speech.
