INDIANAPOLIS, Ind. (ADAMS) – Governor Holcomb has lost the first round in the fight over the new law that limits his emergency powers.
On Thursday, Marion County judge ruled against the governor in his challenge to the law and the state legislature. Lawmakers this spring approved a law that gives them some say in prolonged emergencies.
The governor challenged the law on Constitutional grounds, saying only he can call lawmakers back for a special session where they could act on the law.
The judge said Indiana’s constitution allows lawmakers to set their own schedule.
This is not the end of the fight.
Politicos expect the case to eventually end up before the Indiana Supreme Court.
